Open Burning & Burning Permits

Yard Waste & Recreational Burn Permits

The Sunrise Beach Fire Protection District issues free burn permits to anyone wishing to perform open burning activities. Permits can be obtained by CLICKING HERE.  Burn permits are not issued when the following conditions exist:

  1. Wind speeds above 10 mph
  2. Humidity below 30%
  3. When weather and call volume changes dictate permits to be discontinued for the day.

Utility burns that contain yard waste must be extinguished by dark. Recreational bonfires are permitted after sundown, but a permit must be obtained.

Open burning may only be performed on yard waste or untreated wood and lumber. Plastics, painted items, and trash are not permitted to be burned openly.

Trash may be burned in a burn barrel.

Open burning activities should not be within 25 feet of a structure, no larger than a 4 x 4 foot square, a garden hose and fire extinguisher should be at the fire site.
NO OPEN BURNING SHALL BE LEFT UNATTENDED.

Construction burns are permitted, but a fire watch must be present for the duration of the burn. Unattended construction/land clearing burns will be dealt with accordingly and the Missouri Department of Natural Resources (DNR) may be notified.

Land Clearing Burn Permits

On March 16, 2026, the Sunrise Beach Board of Directors passed ordinance 2026-01. New restrictions and fines have been passed in this ordinance concerning construction and land clearing burns.

As of the date of adoption, all burns are required to be attended at all times. Air curtains will be required as prescribed in the State Code of Regulations. The full section of the ordinance on open burning is on the back of this page.

Fines and fees for service will be imposed should the District have to respond to your burn location. There is a new burn permit link that can be found at www.sbfpd.org. A burn permit must be acquired for each day you are burning.

Please be safe with your burns, monitor them and should you have any questions you may contact the Fire Marshal.

F307.1.1.2 (Page 51) Prohibited Open Burning: add new sub-section,

The Fire Marshal shall order the extinguishment of any open burning when the wind speed is 10 miles per hour or higher, or the humidity is 30% or lower or when the burning creates or adds to a hazardous or unsafe condition. All utility burns are to be extinguished at dusk, excluding small recreational bon fires and fire pits.

Open burning is defined as the burning of any materials in which air contaminants are emitted directly into the air without first passing through a stack or chimney.

Open burning of for land clearing purposes and other associated construction burns shall be done in accordance with Missouri’s Code of Regulations 10 CSR 10-6.045 Open Burning Requirements. Including air curtain requirements for any burn within 200 yards of an occupied structure.

 Any contractor planning a construction burn shall notify the District via the District’s construction permit process, provide 24-hour contact information and follow all requirements for open burning. Construction burns shall be subject to the same daily no burn policies as listed above. A Construction Burn Permit must be obtained for each day of burning.

All construction burns shall be monitored and tended to by the party igniting the fire or a designee for the duration of the burn. Any construction burns left unattended or not properly extinguished shall be subject to fines assessed as follows each time the District responds to the location of the burn:

  • 1st offense – warning
  • 2nd offense – $500.00
  • 3rd offense – $1000.00 (additional $500 per instance)

An additional $500.00 will be assessed for each subsequent response in a 30-day period. Should the District be required take action to extinguish the fire, additional hourly rates will be assessed in accordance with the FEMA fee schedule which will include hourly apparatus costs, fuel costs, hourly rates of employees and hourly rates of equipment.

The District will place liens on the property in the event the party burning fails to pay the fees.
